Terms of Service

These Terms of Service (“Terms”) govern your use of KaleidoPen (the “App”). By downloading, purchasing, or using the App, you agree to these Terms. If you do not agree, do not use the App.

KaleidoPen is licensed, not sold. These Terms supplement the Apple Standard End User License Agreement (“Apple Standard EULA”). Where the Apple Standard EULA applies or requires different terms, it controls to that extent.

1. Eligibility

You must be legally capable of agreeing to these Terms. If you are under the age of legal majority where you live, a parent or legal guardian must approve your use of the App and any purchase.

2. License to Use the App

Subject to these Terms and the Apple Standard EULA, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, and revocable license to use KaleidoPen on Apple-branded devices that you own or control, as permitted by the applicable App Store Usage Rules.

You may not copy, redistribute, rent, lease, sell, sublicense, reverse engineer, decompile, modify, bypass feature or purchase restrictions, or attempt to derive the source code of the App, except to the extent such a restriction is prohibited by applicable law.

3. Creative Work and Your Content

As between you and us, you retain your rights in the drawings, animations, and other creative works you make with KaleidoPen. Subject to the rights of others and applicable law, you may use and export your original creations for personal or commercial purposes.

You are responsible for photos, text, emoji, and other material you import or use. You must have the necessary rights and permissions and must not use the App to create, store, or share content that is unlawful, infringing, abusive, or otherwise violates another person’s rights.

The App itself—including its code, interface, branding, built-in brush designs, presets, icons, and other supplied assets—remains owned by us or our licensors. Your right to use exported artwork does not transfer ownership of the App or permit extraction or resale of built-in assets as a competing asset library.

4. Free and Pro Features

KaleidoPen may provide free functionality and optional Pro functionality, including premium brushes, advanced symmetry and presets, photo tools, longer or watermark-free exports, and other creative features described in the App. Available features may change as the App evolves. Changes will not remove an active entitlement in a manner prohibited by applicable law or App Store rules.

5. Auto-Renewable Subscriptions

KaleidoPen may offer monthly and annual auto-renewable subscriptions. The exact price, billing period, included benefits, and any introductory offer are shown on the purchase screen and App Store confirmation sheet before you purchase.

• Payment is charged to your Apple Account when Apple confirms the purchase.
• Your subscription renews automatically for the selected period unless you cancel it in your Apple Account subscription settings before renewal, subject to Apple’s applicable billing rules.
• Renewal is charged to your Apple Account at the price disclosed by Apple, subject to any price-change notice or consent Apple requires.
• If a free trial or introductory offer is available, eligibility and conversion to a paid subscription are determined and displayed by Apple. Cancel before the trial ends if you do not want the paid subscription to begin.
• Deleting the App does not cancel a subscription.

You can manage or cancel subscriptions from your device’s Apple Account settings. Subscription benefits remain available while the entitlement is active.

6. Lifetime and Other Non-Consumable Purchases

The App may offer a one-time lifetime purchase or other non-consumable purchases. A lifetime purchase provides access to the Pro features associated with that product for the supported lifetime of KaleidoPen; it is not a guarantee that every future product, separate app, or unrelated service will be included.

Eligible non-consumable purchases can be restored on devices using the same Apple Account through the App’s “Restore Purchases” function, subject to Apple’s rules.

7. Billing, Cancellations, and Refunds

All purchases are processed by Apple. We do not control payment authorization, billing, cancellation, or refund decisions and cannot issue App Store refunds directly. To request a refund or resolve a billing issue, use Apple’s purchase-support process. Statutory refund and consumer rights available in your country or region are not limited by these Terms.

8. Exports and Third-Party Destinations

You may save or share output to Photos, Files, social networks, messaging services, and other apps. You choose the destination and are responsible for reviewing its terms and privacy practices. Some destinations or editors may alter, recompress, flatten transparency, or otherwise change exported media.

Media formats and capabilities—including GIF, MP4, MOV, transparent backgrounds, resolution, frame rate, and audio—depend on device hardware, operating-system support, storage, and the receiving software. We do not guarantee that every format will be available or preserved by every device or destination.

9. App Availability and Updates

We may improve, update, replace, suspend, or discontinue features or the App. Some updates may be required for continued compatibility, security, or App Store distribution. We do not guarantee uninterrupted operation, compatibility with every device or future operating-system version, or indefinite availability of the App Store listing.

10. Disclaimer of Warranties

To the maximum extent permitted by law, KaleidoPen is provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or that locally stored work cannot be lost. You should export or back up important creations.

11. Limitation of Liability

To the maximum extent permitted by law, we will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, creative work, revenue, profits, or business opportunities arising from your use of or inability to use KaleidoPen.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limits mandatory consumer rights. Additional allocation-of-liability terms in the Apple Standard EULA also apply.

12. Suspension and Termination

You may stop using the App at any time. Your license terminates automatically if you materially violate these Terms. On termination, you must stop using and delete the App, but provisions that by their nature should survive—including ownership, disclaimers, and limitations of liability—will remain in effect. Subscription cancellation and refunds remain governed by Apple and applicable law.

13. Changes to These Terms

We may update these Terms to reflect changes to KaleidoPen, App Store requirements, or applicable law. We will post revised Terms on this page with a new “Last updated” date. Where required, we will provide additional notice or obtain consent. Continued use after updated Terms take effect means you accept them.
